1887 Antique English Mortgage Indenture Vellum Document Trowbridge Wiltshire George Moore Edward Burchell Rodway Fyning Garden Land Wax Seals

Approximately 29" by 22"

Offered here is a large and impressive original antique English legal mortgage indenture on vellum, dated 25th March 1887, from Trowbridge, Wiltshire, England.

This mortgage indenture was executed between George Moore of Trowbridge in the County of Wilts, Builder, as mortgagor, and Edward Burchell Rodway of the same place, Gentleman, as mortgagee. The document conveys a piece or parcel of land containing approximately 12,552 superficial feet (more or less), situated in the tything of Studley in the Parish of Trowbridge, being part of a close of arable or pasture ground called “The Fyning” or “Fyning Garden”, containing eleven acres and one perch. The property is numbered 100 on the Tithe Commutation Map for the parish of Trowbridge, with dimensions and abutments as delineated on the plan drawn on the back of an Indenture dated the 30th day of April 1884, made between William Stancourt of the one part and Rowland Rodway of the other part. The grant also includes a right of way at all times over roads and ways upon the said close, in common with other occupiers.

The mortgage secures the sum of £165 (One Hundred and Sixty-Five Pounds) with interest at the rate of five pounds per centum per annum, payable by equal half-yearly payments on the 25th day of September and the 25th day of March. The document contains standard Victorian mortgage covenants, provisions under the Conveyancing and Law of Property Act 1881, and clauses addressing future advances and redemption rights.

The indenture is penned in fine Victorian copperplate and legal hand on large vellum with red ruling borders throughout. The document bears two original red wax seals on green wafer backing, signed George Moore. Two Seven Shillings and Sixpence revenue stamps dated 1887 are affixed to the document. The dorse bears multiple receipt endorsements in the hand of George Moore, recording further advance payments received from Edward Burchell Rodway across multiple dates from 1877 through 1889, and is witnessed by F. C. Payne, Clerk to Messrs. Mann & Rodway, Solicitors, Trowbridge.

Note: This document is related to and part of the same Mason & Rodway / Mann & Rodway Trowbridge solicitors’ practice archive as the 1871 George Moore / E. Burchell Rodway mortgage of Fyning Garden land — the same parties, the same property, sixteen years on.
